Property Company (Company) (2) Barclays Bank Bimited (Bank) (3) Bracknell Development Corporation (Corporation) and (4) Fluidrive Engineering Company Limited (Fluidrive) contains the following covenants:- "The Company and the Bank for themselves and their respective successors

in title HEREBY jointly and severally COVENANT with the Corporation and Fluidrive and each of them separately and their respective successors in title and assigns that neither the Company nor the Bank will on any part of the land or soil vested in the Company and coloured pink on the said plan dig for excavate or work or permit to be dug for excavated or worked any brick earth or clay therefrom nearer to the boundary marked A-B on the said plan and drawing than the limit of such digging or excavation specifically defined in the said drawing and marked thereon in red The Company and the Bank hereby jointly and severally covenant with the Corporation and Fluidrive and each of them separately and their respective successors in title and assigns that when carrying out such digging excavations and removal as aforesaid they will exercise all diligence and care and leave a bank of earth not less than 12 feet in height on the immediate south eastern boundary of the said land coloured pink and shown with a thick black line and black hatching in the said drawing so as to give adequate support to the boundary fence now erected or to be hereafter erected along the boundary marked A-B on the said plan by the Corporation and Fluidrive." The land is subject to the following rights granted by the Deed dated 29 August 1953 referred to above: "The Company as Beneficial Owner and the sank as Mortgagee HEREBY GRANTS unto the Corporation in fee simple the full right and liberty at all times hereafter to have all buildings now or at any time hereafter to be erected upon the land coloured green and blue on the said plan and any buildings to be erected upon the same foundations as any of the said buildings to be erected as aforesaid (and requiring for their stability the same support as or any less support than the said buildings require from the soil of the servient tenement lateral or subjacent) supported upheld and maintained by the subsoil and minerals of the servient tenement.''
